1. Introduction

Dionne Schulze is subject to the Act respecting the protection of personal information in the private sector, CQLR c. P-39.1, which regulates the way Quebec private sector organizations collect, use, retain, secure and disclose personal information.

Our firm recognizes the importance of privacy and the sensitive nature of the personal information we receive in the course of our legal practice. As our practice is governed by the Professional Code, CQLR, c. C-26, we recognize our professional obligation to maintain the confidentiality of all information about our clients (whether individuals or organizations).

This policy applies to information collected through our website, www.dionneschulze.ca, and in the course of the lawyer-client relationship.

2. What is personal information?

“Personal information” means any information about an individual that can be used to identify that individual. This includes, but is not limited to, an individual’s first and last name, address, email address, telephone number and banking information.

3. What personal information do we collect, use, disclose and retain?

Depending on the circumstances, we may collect, use, disclose and retain some of the following information:

-Identity information such as first and last name, date of birth, SIN, contact information for the organization or band council, registration number with the Registre des entreprises du Québec or Corporation Canada, and the nature of an organization’s activities.

-Contact information such as address, email address and phone number.

-Billing information such as billing address, payment information or bank account information.

-Recruitment information such as resume, education and employment history, criminal record where warranted by the nature of the position, and Ordre membership record for pre-employment screening where required, as well as any information relevant to potential hiring.

-Identifying information such as a copy of a driver’s license, passport or utility bill.

-Sensitive information such as your medical or criminal records.

-Information about legal services we have provided to you.

Depending on the purpose of our legal mandate, we may need to collect, use, disclose and retain other personal information about you.

We may also communicate to third parties the information necessary to carry out our mandate. See section 6 for more information.

  • If you are a minor under the age of 14

We do not knowingly collect, use, disclose or store information from minors under the age of 14 without the consent of a parent or guardian, unless such collection is clearly for the benefit of the minor. If we learn that we have collected personal information from minors under the age of 14 without verifying the consent of a parent or guardian, we will take steps to delete such information from our servers.

  • If you are a user of our website

We collect the Internet Protocol (IP) addresses of users of our website. Users’ IP addresses are automatically logged. An IP address alone cannot reveal a person’s identity. However, under certain circumstances, it can be used to identify the user of a website. For this reason, the IP address may be considered personal information, especially when combined with other information that is automatically collected when a user accesses a website (through the use of cookies). This information may include the name of the page you viewed, and the date and time you viewed it.

Unless otherwise specified, we do not automatically collect, use, disclose or store any specific information about you.

  • If you are a user of our online forms

The forms on our website can help you contact us about class action lawsuits and allow you to join our mailing list to receive updates about cases. We only ask for the information we need to respond to your inquiry.

4. Why do we need your personal information?

We collect, use, disclose and store your personal information in order to:

-Respond to your requests for information related to our services;

-Review and respond to employment applications;

-Administer payment of fees and disbursements;

-Provide legal services, for which we must have access to all relevant facts and information. This information necessarily includes personal information about our clients, and may include information about people other than our clients;

-In order to carry out our mandate properly, we may also need to collect and disclose to third parties the documents we need to carry out our mandate (such as identification documents, tax returns, etc.).

-Enable us to prove alleged facts within the scope of our mandates;

-Direct clients or potential clients to people and resources to help with problems relating to our mandates.

We take steps to ensure that the personal information we collect is adequate, relevant, not excessive and used for limited purposes.

5. How do we use your personal information?

The firm will use personal information only for the purpose for which it was collected or for a use consistent with that purpose, unless consent for another use has been obtained or is permitted by law.

6.Do we disclose and communicate your information to third parties?

We may disclose your personal information to comply with any court order or to  respond to governmental or regulatory requests, in keeping with applicable laws. We will not disclose any information covered by solicitor-client privilege except with the permission of the client, to respond to a court order, or as otherwise permitted by law.

In order to comply with our legal obligations, we may need to share your personal information with third parties, in particular to our service providers in connection with the services they provide to us. We limit the information we share with these third parties to that which is reasonably necessary for them to perform their functions.

7. Is your personal information transferred outside Quebec?

Your personal information is currently hosted on secure servers that may be located outside of Quebec, in the United States.

We may also share your personal information with third parties located outside of Quebec (for example, Canadian lawyers located outside of Quebec who act as agents for us), in the course of carrying out our mandate.

You consent to the transfer of your information to these jurisdictions, which may have privacy laws that differ from those in Quebec.

8. How do we protect your personal information?

The security of your personal information is important to us. We have implemented appropriate and reasonable physical, organizational, contractual and technological security measures to protect your personal information from loss or theft, unauthorized access, disclosure, copying, use or modification.

We have taken steps to ensure that only those employees who need to access to your personal information to perform their job are authorized to access it. Persons working for or on behalf of Dionne Schulze must:

-Use reasonable efforts to minimize the risk of inadvertent disclosure of personal information;

-Take special precautions to ensure that personal information is not monitored, overheard, accessed or lost when working on premises other than Dionne Schulze’s offices.

If your personal information is transferred outside of Quebec, we will take reasonable steps to ensure that your personal information is adequately protected in accordance with this policy and applicable laws, including through contractual obligations.

Despite these measures, no method of transmission or storage is 100% secure or error-free. If you have reason to believe that your interaction with us is no longer secure, please contact us immediately using the contact information provided in section 16. If we become aware of a breach of security involving your personal information, we will notify you and the relevant authorities as soon as possible, in accordance with the law.

9. What happens to your personal information if you are redirected to another website or social media site?

We provide links on our website to third-party websites or social media sites. These third-party sites have separate and independent privacy policies. We are not responsible for the content or activities of these linked sites. We do not control these third-party sites and encourage you to read the privacy policy of each site you visit.

10. Retention and disposal of your personal information

Except as permitted or required by applicable laws or regulations, we will retain your personal information only as long as necessary to fulfill the purposes for which it was collected, including satisfy any legal, accounting or reporting requirements to appropriate governmental and regulatory authorities. In certain circumstances, we may anonymize your personal information so that it can no longer be associated with you.

We have a file classification system that establishes specific retention periods for different types of information in Dionne Schulze’s custody and control. These schedules are reviewed periodically to ensure that personal information is retained no longer than necessary to fulfill its the original purpose.

When personal information is no longer needed, we will dispose of it in a secure manner.

11. Right to request access to personal information

If you wish to review or verify your personal information, please follow the procedure described in  section 16.

Applicable laws may permit or require us to deny you access to some or all of the personal information we hold about you, or we may have destroyed, deleted or anonymized your personal information.

If we are unable to provide you with access to your personal information, we will inform you of the reasons, subject to any legal or regulatory restrictions.

12. Would you like to request the correction of your personal information?

It is important that the personal information we hold about you be accurate and up to date. Please keep us informed of any changes to your personal information. By law, you have the right to access and correct the personal information we hold about you.

If you wish to correct the personal information you have provided to us, please follow the procedure described in section 16.

We may not comply with a request to amend information if we believe that the amendment would violate any law or regulatory or would result in inaccurate information.

13. How do we obtain your consent?

We consider your consent to the collection, use or disclosure of your personal information to be valid:

-If it is expressly given by your written or oral consent;

-When you voluntarily provide personal information for an obvious purpose (e.g. our mandates, forms on our website);

-If you do not object to the firm’s collection, use or disclosure of personal information within a reasonable time after we have clearly informed you, including through this Policy, of our intention to do so and the purposes for which will be used.

14. Would you like to withdraw your consent?

Once you have consented to the collection, use and disclosure of your personal information, you may withdraw your consent in certain circumstances.
